INDEMNIFICATION: The Buyer shall indemnify, save and hold harmless Bristol Virginia Public Schools (BVPS), its officers, agents, employees and volunteers against and from any and all injuries, death, loss, damage, claims, patent claims, suits, liabilities, judgments, costs of investigation, attorney fees, cost of appeals arising out of any such claims or suits, and other expenses which may otherwise accrue against BVPS in consequence of the purchase and removal of the item(s) or which may or otherwise result in connection with work therefrom, if it shall be determined that the act was caused through negligence, omission or commission of the Buyer, including its agents, subcontractors, employees, and volunteers. The Buyer expressly understands and agrees that any insurance shall in no way limit the responsibility to indemnify, keep and save harmless and defend BVPS as herein provided.

Buyer must sign a Bristol Virginia Public Schools Employee Disclosure form before removing items. Per Bristol Virginia School Board Policy File:DN The bidder or purchaser shall certify whether he/she is an officer or employee of the division or a member of the immediate family of an officer or employee. Officers and employees of the school division, and members of their immediate family, may purchase surplus property from the school division only if the property is being sold at uniform prices available to the public or if the goods are sold for less than $500.00.
